BNSF, Green Groups Reach Tentative Deal In Coal Dust Suit
Law360, New York (November 15, 2016, 6:14 PM EST) -- BNSF Railway Co. and seven environmental groups announced a tentative deal on Tuesday to resolve a Washington federal court dispute claiming coal dust regularly flies off the company's trains and into waterways, with the company agreeing to put $1 million toward environmental projects and to study methods for covering coal trains.
Under the settlement, BNSF denies the Clean Water Act violations alleged by the groups, which include Sierra Club, Puget Soundkeeper, Columbia Riverkeeper, Spokane Riverkeeper, RE Sources for Sustainable Communities, Natural Resources Defense Council and Friends of the Columbia Gorge, according to a statement from the company.
