UnitedHealth Sued Again Over Prescription Copay Clawbacks
By Dani Kass (November 16, 2016, 3:38 PM EST) -- UnitedHealth Group Inc. and several of its subsidiaries on Tuesday were again accused of charging customers prescription copayments that exceed the cost of drugs and pocketing the difference, in what is at least the second potential class action over the alleged clawbacks.
Florida resident Kathy Fellgren said the Minnesota-based insurer and its pharmacy benefit management arm, OptumRx, regularly profit off customer overpayments and make pharmacists sign contracts with gag clauses, which stop them from protecting customers. Her suit alleges breach of contract and violations of consumer protection statutes and the Racketeer Influenced and Corrupt Organizations Act.
