Insurer Has Duty To Defend Furmanite: Appeals Court

Law360 (February 9, 2009, 12:00 AM EST) -- A Texas appeals court has dismissed an insurer's claims that it has no duty to defend Furmanite America Inc. in a Louisiana toxic tort case, affirming an earlier trial court ruling on the long-standing coverage dispute.

On Thursday, the Court of Appeals of Texas for the Fourteenth District sided with Furmanite in the spat, batting down attempts by Solvent Underwriters Subscribing To Energy Insurance International Inc. to wriggle out of defending the company, which specializes in containing hazardous material.
