Judge Tosses Donning, Doffing Action Against Tyson

Law360, New York (February 10, 2009, 12:00 AM EST) -- A federal court has dismissed a proposed class action against Tyson Foods Inc. over the company's alleged failure to pay its meatpacking employees all the wages they were owed, saying that the plaintiffs' state law claims are preempted by federal law.

The ruling, handed down Monday by Judge Michael M. Mihm of the U.S. District Court for the Central District of Illinois, leaves intact a claim under the Fair Labor Standards Act that includes only individual plaintiffs rather than a proposed class. It does not affect...
