Malpractice Insurer Wants Costs After $4.7M Judgment Flip

By Cara Salvatore (December 5, 2016, 8:52 PM EST) -- Medical Mutual Insurance Co. of North Carolina has sued Indian Harbor Insurance Co. over the aftermath of a $4.7 million medical malpractice judgment, according to a suit removed to North Carolina federal court on Monday.

Arleen Thom, M.D., was found liable for $4.65 million for medical malpractice after a jury verdict in 2012. Raleigh-based Medical Mutual, an insurer of North Carolina physicians, was in turn insured by Indian Harbor. Medical Mutual provided help to Dr. Thom on appeal, with support from Indian Harbor, and was able to get the judgment overturned.
