Fed. Circ. Affirms Ax Of Patents OK'd Under New Alice Rules

By Kevin Penton (December 8, 2016, 3:58 PM EST) -- The Federal Circuit on Thursday affirmed an Ohio federal court's order that the asserted claims of five vehicle-tracking patents are invalid under Alice, even though four of the patents were issued under new guidelines for applying the landmark U.S. Supreme Court decision.

The three-judge appellate panel did not expand on its rationale, issuing a one-sentence order that upheld the toss of the asserted claims of MacroPoint LLC's patents under the high court's 2014 ruling in Alice Corp. Pty. Ltd. v. CLS Bank International, which held that abstract ideas implemented using a computer are not patent-eligible under Patent Act Section 101....
