CSX Units Must Pay For NJ River Cleanup: 3rd Circ.

Law360, New York (February 12, 2009, 12:00 AM EST) -- Two CSX Corp. subsidiaries must indemnify Pharmacia Corp. for the costs of investigating river contamination possibly stemming from a former chemical manufacturing site in Kearny, N.J., a federal appeals court has ruled.

The U.S. Court of Appeals for the Third Circuit on Tuesday upheld a portion of a lower court ruling holding CSX Intermodal Inc. and its subsidiary, Motor Carrier Services Group, responsible for funding part of the investigation along the lower Passaic River near Newark.
