Class Bid Denied In Billing Suit V. Diagnostics Co.

Law360, New York (February 12, 2009, 12:00 AM EST) -- A federal judge denied nationwide class certification in a protracted spat over Quest Diagnostics Inc.'s billing practices, ruling that the proposed class lacked cohesiveness and the sundry allegations, including fraud and racketeering, required individual analysis.

On Wednesday, Judge Stanley R. Chesler of the U.S. District Court for the District of New Jersey rejected the class bid, holding the plaintiffs' accusations of overbilling too various and unique to qualify for class status.
