Hercules Bid For Cleanup Reimbursement Survives

Law360, New York (February 13, 2009, 12:00 AM EST) -- A federal judge has ruled that Hercules Inc. may continue to pursue reimbursement for a 2008 settlement with environmental regulators from Delaware Valley Scrap Co. Inc., which handled toxic waste removal for the chemical manufacturer in the 1970s, based on contracts requiring the waste disposal company to indemnify Hercules for contamination caused by the defendant.

On Feb. 11, Judge Renee Marie Bumb of the U.S. District Court for the District of New Jersey refused a bid from Delaware Valley Scrap Co. Inc. to dismiss the suit....
