2nd Circ. Paves Way For Antitrust Suits V. AmEx

Law360 (February 18, 2009, 12:00 AM EST) -- Days after the U.S. Court of Appeals for the Second Circuit handed American Express Co. a setback in an antitrust case brought by a group of merchants, two suits involving the same class action waiver provisions have been given the green light to proceed.

On Friday, U.S. District Judge William H. Pauley granted the action of plaintiffs Performance Labs Inc. and Lopez Delonge to unfreeze their suits, which had been stayed until the Second Circuit ruled in the In Re American Express Merchants’ Litigation.
