Class Status Nixed In FLSA Case V. Erie Indemnity

Law360 (February 23, 2009, 12:00 AM EST) -- A judge has refused to give conditional class certification in a lawsuit brought by a claims adjuster who alleges that he and his peers were not properly paid overtime while working for Erie Indemnity Co.

In an order Friday, Judge Sean J. McLaughlin of the U.S. District Court for the Western District of Pennsylvania said plaintiff John Stansilaw did not meet the “modest factual showing” that similarly situated employees were affected by the same alleged overtime-related violations of the Fair Labor Standards Act.
