Buyer Class Still Valid In Nifedipine Antitrust Suit

Law360 (February 24, 2009, 12:00 AM EST) -- A federal appeals court has decided not to review the class status of a group of direct purchasers that accused Biovail Corp., Elan Corp. PLC and Teva Pharmaceuticals Ltd. of conspiring to restrain the sale of nifedipine, a generic version of hypertension drug Adalat CC.

In a per curium order issued Monday, a three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit denied the defendants' petition for leave to appeal the granting of class certification.
