Teva Loses Bid To Toss Novartis Claims Over Famvir

Law360, New York (February 25, 2009, 12:00 AM EST) -- A federal judge has refused to dismiss willful infringement claims against Teva Pharmaceuticals USA Inc. or grant the generics maker summary judgment in a patent dispute with Novartis AG over the genital herpes drug Famvir.

Judge Dennis M. Cavanaugh of the U.S. District Court for the District of New Jersey on Monday found that Novartis still might be able to show after discovery that the generics maker acted in reckless disregard of the likelihood that it was infringing a valid patent, and denied Teva's motion to...
