5-Hour Energy Ordered To Pay $4.3M For Deceptive Ads

Law360, New York (February 9, 2017, 8:23 PM EST) -- The makers of 5-Hour Energy were ordered to fork over nearly $4.3 million in penalties and attorneys' fees and costs for duping consumers with misleading claims regarding things like the effectiveness of the popular flavored energy shots, the Washington attorney general announced Wednesday.

Living Essentials LLC and Innovative Ventures LLC must pay about $2.2 million in civil penalties to Washington state and nearly $2.1 million to cover attorneys' fees and costs, King County Judge Beth M. Andrus held Tuesday after finding for the state on most of its Consumer Protection Act claims in October.
