Judge Sides Against Milbank In Document Spat

Law360, New York (February 26, 2009, 12:00 AM EST) -- A federal district judge has sided against Milbank Tweed Hadley & McCloy LLP in its emergency request for a stay pending appeal of a bankruptcy order regarding certain privileged documents from its work for the now-defunct Montana Power Co.

On Tuesday, U.S. District Judge Sue Robinson of the U.S. District Court for the District of Delaware denied Milbank's emergency bid to freeze document production, ruling that the New York firm had not satisfied its legal obligations to earn the stay.
