Cooper Off Hook For Cleanup At Texas Superfund Site

Law360, New York (March 2, 2009, 12:00 AM EST) -- In a North Texas Comprehensive Environmental Response, Compensation and Liability Act suit brought by Aviall Services Inc. after it spent $15 million to clean up polluted land it bought from Cooper Industries LLC, a judge has freed Cooper of liability for one of two sites because Aviall did not properly notify all parties “forseeably affected” by the contamination, as required by federal law.
