9th Circ. Upholds Toss Of Activists' Egg Carton Label Suit

Law360, Los Angeles (February 27, 2017, 9:20 PM EST) -- The Ninth Circuit on Monday affirmed a dismissal of animal advocacy groups’ suit against federal agencies, including the U.S. Food and Drug Administration, petitioning for stricter regulations on egg carton labeling, saying the agencies either lacked authority to adopt such rules or have discretion to take alternative measures.

The affirmance upholds a December 2014 decision by a California federal judge to reject a suit by animal advocacy groups Compassion Over Killing and Animal Legal Defense Fund against the FDA, Federal Trade Commission and two U.S. Department of Agriculture agencies after they denied rulemaking petitions for all egg cartons to identify conditions...
