Green Groups Can't Fight Forest Rules: High Court

Law360, New York (March 3, 2009, 12:00 AM EST) -- The U.S. Supreme Court has found that environmental groups lacked standing to challenge federal rules allowing the U.S. Forest Service to exempt fire rehabilitation activities and salvage logging projects from public comment and appeals processes.

In a 5-4 ruling Tuesday, the court determined in Summers v. Earth Island Institute that the groups could not bring a lawsuit contesting the regulations without tying the dispute to a concrete application of those regulations.
