Chemtura Enviro Claims V. Cone Mills Buyer Barred

Law360 (March 4, 2009, 12:00 AM EST) -- Chemtura Corp. has lost a challenge to a bankruptcy court ruling that barred it from asserting claims of environmental liability against the company that purchased the assets of troubled Cone Mills Corp.

The U.S. Court of Appeals for the Third Circuit on Tuesday affirmed a district court's order that let stand a bankruptcy judge's ruling that Chemtura was bound by the sale of Cone Mills' assets to the predecessors of International Textile Group and could not assert successor liability claims against ITG Inc.
