In Setback for AstraZeneca, E.U. Court Rules for Generics

Law360 (October 17, 2003, 12:00 AM EDT) -- In a setback for large pharmaceutical companies, the European Court of Justice on Thursday backed Generics U.K. Ltd.'s bid to market older, capsule versions of AstraZeneca's Losec heartburn drug under a fast-track procedure, the Wall Street Journal reported Friday.

In their ruling, the judges wrote that encouraging the sale of older but safe versions of drugs avoids "the repetition of tests on humans or animals" and "save the time and expense needed to gather the results" of carrying out new tests, according to the Journal....
