Congoleum Judge Stays Dismissal Pending Appeal

Law360 (March 4, 2009, 12:00 AM EST) -- Though she tossed out the case earlier this week, the federal bankruptcy judge overseeing the Congoleum Corp. Chapter 11 proceedings has agreed to stay her controversial decision while the asbestos-plagued flooring manufacturer pursues an appeal in the district court.

On Tuesday, Judge Kathryn Ferguson of the U.S. Bankruptcy Court for the District of New Jersey opted to freeze the dismissal order she handed down on Feb. 26, admitting “good cause” existed to justify the move.
