Canada Prevails In $383M Eli Lilly Case

Law360, New York (March 19, 2017, 9:13 PM EDT) -- Canada has prevailed in a CA$500 million ($383 million) arbitration claim filed by U.S. drugmaker Eli Lilly over the alleged wrongful termination of its drug patents.

The International Centre for the Settlement of Investment Disputes tribunal — composed of presiding arbitrator Albert Jan Van Den Berg, along with Canada appointee Daniel Bethlehem and Eli Lilly appointee Gary B. Born — issued an award on March 16 rejecting Eli Lilly's claims, which had been filed under the North American Free Trade Agreement.
