Ariz. Supreme Court Nixes Atty Fee Award In Contract Row

Law360, New York (March 23, 2017, 8:58 PM EDT) -- The Arizona Supreme Court on Thursday threw out attorneys' fees awarded to the successful party in a yearslong contract dispute between a scooter vendor and retailer, saying state law came down in favor of the losing side of the dispute because the winner had rejected the loser's written settlement offer.

Vice Chief Justice John Pelander wrote for the high court in a 4-1 decision that American Power Products Inc., the winner in the contract dispute, had sought $5 million in damages and rejected a $1 million written settlement offer from CSK Auto Inc., which under state law made CSK the successful party...
