Texas Doctor Off Hook In $14M Liability Award

Law360, New York (March 9, 2009, 12:00 AM EDT) -- The highest court in Texas on Friday struck down a doctor's portion of a $14 million medical liability judgment, remanding the case back to a trial court, but upheld the judgment insofar as it pertained to the doctor's insurer.

The trial court judgment, which followed a hysterectomy patient's 2002 death, may not exceed an approximately $1.5 million statutory cap and the state's court of appeals in Amarillo erred in affirming the excess amount with respect to defendant Dr. Benny P. Phillips, according to the 5-4 opinion...
