High Court Won't Hear Apotex Appeal Over Prilosec

Law360 (March 9, 2009, 12:00 AM EDT) -- The U.S. Supreme Court has declined to hear an appeal from Apotex Corp. in an infringement dispute with AstraZeneca AB over patents for the heartburn medication Prilosec.

The high court on Monday denied the generic-drug maker's petition for writ of certiorari, letting stand a May 2007 federal district court ruling that Apotex infringed AstraZeneca's patents for the drugs.

The case will now be returned to the lower court to determine damages, AstraZeneca spokesman Blair Hains said.
