Dr. Reddy's Generic Doesn't Infringe Prilosec: Judge

Law360 (March 10, 2009, 12:00 AM EDT) -- A federal judge has dismissed AstraZeneca AB’s patent lawsuit against Dr. Reddy’s Laboratories Ltd. over the generic formulation of popular over-the-counter antacid medication Prilosec.

The judge dismissed the case on Tuesday after agreeing with the defendants that Dr. Reddy’s drug used a different form of omeprazole magnesium, the primary ingredient in Prilosec, than what was covered in the AstraZeneca patents. The patents at-issue in the lawsuit cover the OTC version of AstraZeneca’s blockbuster heartburn drug Prilosec.
