Abigail L. Brown Nearly one year ago, then-President Barack Obama signed the Defend Trade Secrets Act into law. Under the DTSA, trade secret owners now receive the same federal legal protection offered to owners of trademarks, copyrights and patents.

State laws have long provided protection for trade secrets, with all but three states having adopted the Uniform Trade Secrets Act.[1] The DTSA provides litigants protections previously offered by the UTSA, and now provides the opportunity to bring trade secret claims in federal court, regardless of diversity of citizenship.
