Snack Cos. Launch Trademark Battle Over 'Skinny' Popcorns

Law360, New York (April 12, 2017, 8:06 PM EDT) -- Snack giant Snyder's-Lance and the company behind SkinnyPop Popcorn kicked off a trademark battle Tuesday over dueling "Skinny" brands.

In a declaratory judgment lawsuit filed in North Carolina, Snyder's said Amplify Snack Brands had been threatening an infringement lawsuit over plans for U.S. sales of Metcalfe's Skinny, a U.K.-only line of healthy popcorn purchased by the snack conglomerate in September.

Just one problem: "Skinny" is the kind of descriptive term that can't be locked up under trademark law, Snyder's says.
