Ex-Walgreens Worker Fires Off FLSA Suit Over OT

Law360, New York (March 16, 2009, 12:00 AM EDT) -- A former assistant manager for Walgreen Co. has launched a proposed collective action accusing the drugstore chain of intentionally misclassifying assistant managers as exempt from federal law mandating time-and-a-half wages for overtime.

The complaint, filed Friday in the U.S. District Court for the Southern District of Florida, alleges that the company — along with several unknown divisions, subsidiaries or affiliates — willfully denied several thousand assistant managers across the country overtime wages in violation of the Fair Labor Standards Act.
