Philip Morris Loses Round In 'Light' Marketing Case

Law360, New York (March 16, 2009, 12:00 AM EDT) -- Citing a recent U.S. Supreme Court decision, Massachusetts' highest court has affirmed a lower court's decision in favor of smokers who allege that the marketing of Philip Morris Inc.'s Marlboro Lights is deceptive, allowing their case to proceed.

In a decision Monday, the Massachusetts Supreme Judicial Court said Philip Morris had not met its burden of showing that the U.S. Federal Trade Commission affirmatively permits the use of descriptors such as "light" and “lower tar and nicotine” on cigarette packages.
