Okla. Justices Revive Part Of Osage Nation Wind Farm Row
Law360, New York (May 3, 2017, 7:13 PM EDT) -- The Oklahoma Supreme Court on Tuesday mostly upheld the dismissal of claims the Osage Nation asserted to fight approvals for a wind farm in Osage County, but revived the tribe’s claim challenging the validity of a zoning ordinance that greenlighted its construction and operation.
The Oklahoma Supreme Court’s ruling arises from two related District Court of Osage County proceedings brought by the Osage Nation and the Osage Minerals Council in 2014 over a zoning ordinance adopted by the county Board of Commissioners and a conditional use permit approved by the county Board of Adjustment for Osage Wind LLC’s wind farm in...
