Parties Argue Bilski In BofA 'Keep the Change' Suit

Law360 (March 17, 2009, 12:00 AM EDT) -- A patent infringement suit between Bank of America Corp. and Every Penny Counts Inc. over the bank's “Keep the Change” program has turned to a debate on whether the patent-at-issue holds up under In Re Bilski.

EPC filed a summary judgment motion for validity Monday arguing that the U.S. Court of Appeals for the Federal Circuit's decision in In Re Bilski does not apply to its patent because the claim at issue covers part of a system, rather than a method or process.
