Power Co. Can't Alter New Pricing Model: DC Circ.

Law360 (March 17, 2009, 12:00 AM EDT) -- A federal appeals court has denied Public Service Electric and Gas Co.'s petition to review Federal Energy Regulatory Commission orders on a new model for pricing electricity, shutting down the power company's bid to alter a provision of the model.

In a ruling handed down Tuesday in the U.S. Court of Appeals for the District of Columbia Circuit, a three-judge panel said it was unconvinced that FERC had acted “either arbitrarily or capriciously,” when it approved the Reliability Pricing Model.
