Fiber Optic Patent Description Too Vague, Fed. Circ. Says
Law360, New York (May 10, 2017, 8:49 PM EDT) -- The Federal Circuit ruled Wednesday that a fiber optic technology patent held by Cirrex Systems LLC is invalid for lack of a written description, handing Cisco Systems Inc. a win after a PTAB re-examination it initiated.
In a precedential decision, a three-judge panel corrected the Patent Trial and Appeal Board’s construction of two key terms related to the technology and held that under the right interpretation, the claims lacked a sufficient written description.
“Because all the claims on appeal are unpatentable for lack of written description support, we affirm, in part, and reverse, in part,” according to the opinion.
