Internal E-mails Fair Game In AuthenTec Suit: Judge

Law360, New York (March 20, 2009, 12:00 AM EDT) -- Technology company AuthenTec's internal e-mails can be used in litigation by shareholders in a securities class action that accuses the company and two of its officers of artificially inflating the stock price by failing to disclose slumping sales, a judge has ruled.

Judge David A. Baker of the U.S. District Court for the Middle District of Florida denied AuthenTec's motion for a protective order prohibiting the use of allegedly “misappropriated” AuthenTec e-mails or information gleaned from them.
