Judge Tells Alcoa, Retirees To Prepare For Battle

Law360, New York (March 20, 2009, 12:00 AM EDT) -- A judge overseeing an Employee Retirement Income Security Act class action brought by a group of retirees against aluminum producer Alcoa Inc. has rejected both sides' pleas for summary judgment, telling everyone involved to prepare for trial in the case over health benefits.

U.S. District Judge Thomas W. Phillips of the Eastern District of Tennessee on Thursday rejected the summary judgment bids.
