BD Nova Wins $5.9M In Fees In Abbott Patent Case

Law360 (March 20, 2009, 12:00 AM EDT) -- Attorneys for Becton Dickinson & Co. and Nova Biomedical Corp. have been awarded $5.9 million in fees in a patent dispute with Abbott Laboratories Inc. over test strips used to monitor blood glucose levels.

Judge William Alsup of the U.S. District Court for the Northern District of California awarded the fees Thursday, but said Abbott would only need to pay if an appeals court upheld a judgment finding U.S. Patent Number 5,820,551 unenforceable for inequitable conduct.
