PTAB Wrongly Nixed Imaging Patent Claims, Imperium Says

Law360, New York (June 19, 2017, 2:52 PM EDT) -- The Patent Trial and Appeal Board wrongly invalidated claims in two patents covering digital camera imaging technology when it introduced its own reasoning as to why the claims challenged by Samsung were obvious and anticipated, Imperium IP Holdings told the Federal Circuit on Thursday.

In opening briefs in two related cases, the nonpracticing entity argued that Samsung Electronics Co. Ltd. didn’t show how and why prior art references disclose the imaging inventions, or why an ordinarily skilled person would be motivated to combine or modify them. Instead, the board improperly presented its own theories, Imperium said.
