Insurer Wants Dallas Labs' Policies Vacated Over Fraud Suits

Law360, Houston (July 14, 2017, 9:27 PM EDT) -- Berkley Insurance Co. told a federal judge in Texas on Thursday it needs a declaration from the court that it's not required to defend Next Health LLC against a series of lawsuits alleging fraudulent practices because Next Health made misrepresentations about its conduct in applying for the policies.

Berkley asked the court for a judgment that it can rescind three policies because of the “material representations” Next Health made in its applications, or alternatively, that the policies don't provide coverage for four pending lawsuits the company...
