Judge Won't Toss Teacher Group's Suit V. Insurer

Law360 (March 31, 2009, 12:00 AM EDT) -- A federal judge has refused to dismiss the California Teachers Association's duty-to-defend lawsuit against an insurer, as the 330,000-member labor group faces an underlying case accusing it of unlawfully imposing a trusteeship over one of its affiliates.

In denying the New Hampshire-based RSUI Indemnity Co.'s motion to dismiss on Monday in the U.S. District Court for the Central District of California, however, Judge Otis D. Wright II said the insurer's attack on the lawsuit would be more appropriately addressed in a motion for summary judgment....
