Bumble Bee Sues Equipment Maker After $40M Recall

Law360, New York (March 31, 2009, 12:00 AM EDT) -- Bumble Bee Foods Inc. has launched a lawsuit against an equipment manufacturer, claiming that a faulty food sterilization system caused $40 million in losses after hot dog chili sauce manufactured on the custom-made equipment allegedly led to at least four cases of botulism.

Filed in the U.S. District Court for the Southern District of Georgia, the suit accuses Malo Inc. of negligence in designing the food sterilization system and of breaching its ordinary duty of care by failing to warn the company about the system's design...
