Terrorism No Issue In Nuclear Relicensing: 3rd Circ.

Law360, New York (March 31, 2009, 12:00 AM EDT) -- The U.S. Nuclear Regulatory Commission does not have to examine the environmental impact of a hypothetical terrorist attack on a nuclear power facility while reviewing an application to relicense it, a federal appeals court has decided.

The United States Court of Appeals for the Third Circuit ruled Tuesday that the New Jersey Department of Environmental Protection cannot intervene in the relicensing of a New Jersey nuclear power plant on grounds that the National Environmental Policy Act requires analysis of the impact of a potential terrorist attack....
