Allstate Loses Bid To Toss Wyeth Coverage Spat

Law360 (April 1, 2009, 12:00 AM EDT) -- A federal judge has denied Allstate Insurance Co.'s bid for summary judgment in a dispute over whether the insurer is obligated under its excess policies to pay the costs of defending product liability lawsuits against Wyeth involving the anxiety drug Ativan.

Magistrate Judge Henry Pitman of the U.S. District Court for the Southern District of New York on Tuesday rejected Allstate's request for summary judgment while also denying in part and granting in part Wyeth's cross-motion for summary judgment.
