Conditional Cert. Granted In Age Bias Suit V. PPG

Law360 (April 1, 2009, 12:00 AM EDT) -- A federal judge has granted conditional class certification in a suit accusing Pittsburgh-based paint and chemicals supplier PPG Industries Inc. of systematically discriminating against its older workers.

Judge Arthur J. Schwab of the U.S. District Court for the Western District of Pennsylvania on Wednesday ruled that conditional class certification was appropriate based on the lenient standard applied at this early stage in the litigation.

The ruling gives putative class members the opportunity to opt in to the suit and allows the process of discovery to begin....
