SC Sues US For $100M Over Failure To Remove Plutonium

Law360, New York (August 8, 2017, 7:27 PM EDT) -- South Carolina on Monday sued the federal government in Federal Claims Court, seeking $100 million and alleging the U.S. Department of Energy failed to live up to its obligation to remove a ton of plutonium from an industrial facility near the Savannah River.

The DOE must remove at least one ton of plutonium from the site or pay $1 million for each day the task is not completed, with a maximum penalty of $100 million, according to the state.
