6th Circ. Won't Revive Wish.com False Advertising Suit

Law360, New York (August 17, 2017, 6:24 PM EDT) -- A Sixth Circuit panel Wednesday upheld a lower court's decision to toss a putative class action brought by an Ohio man who said he'd been tricked into buying $27 speakers because Wish.com had advertised them as marked down from $300, ruling that the man had shown no actual injury.

In a unanimous, published decision penned by U.S. Circuit Judge Amul Thapar, the panel said that Max Gerboc's claims that ContextLogic Inc., which owns Wish.com, committed fraud, unjustly enriched itself and violated Ohio consumer protection law, fall flat because, ultimately, Gerboc got what he paid for.
