Tomato Processor Wants Antitrust, RICO Suit Tossed

Law360 (April 9, 2009, 12:00 AM EDT) -- SK Foods LP has asked a judge to dismiss a suit alleging that it violated antitrust law by engaging in bribery in the processed tomato products market, saying the complaint against it has failed to state any legitimate claims for relief.

In a motion filed Wednesday in the U.S. District Court for the Eastern District of California, SK Foods said its competitors' claims were not stated under the Robinson-Patman Act, the Sherman Act, the Racketeer Influenced and Corrupt Organizations Act, California Business & Professions Act unfair...
