8th Circ. Nixes Workers' Disability Claims V. Insurer

Law360, New York (April 13, 2009, 12:00 AM EDT) -- A federal appeals court has upheld a lower court's decision to dismiss disabled ex-employees' claims against an insurer for past-due disability benefits and COBRA overpayments, calling for a new trial to resolve whether the employees' benefits were vested at the time the policies were canceled.
