In Boost For Microsoft, PTO Rejects Alcatel Patent

Law360 (April 14, 2009, 12:00 AM EDT) -- The U.S. Patent and Trademark Office has rejected a long-disputed Alcatel-Lucent patent, helping Microsoft Corp. in its quest to overturn a $358 million jury verdict handed down against the software giant.

In an ex parte re-examination proceeding, a USPTO examiner found that two claims of the so-called Day patent – which covers how software users choose a calendar date from a menu in programs such as Microsoft Outlook, Microsoft Money and Windows Mobile – were unpatentable.
