Ex-Workers Win Cond. Cert. In Age Bias Suit V. Sears

Law360, New York (April 16, 2009, 12:00 AM EDT) -- Several former Sears Holdings Corp. employees have won a bid for conditional certification in an age discrimination suit brought on behalf of sales associates who allegedly lost pay and benefits when they were transitioned to a Sears subsidiary.

Judge George Caram Steeh of the U.S. District Court for the Eastern District of Michigan signed an order granting the plaintiffs' motion to conditionally certify the suit as a collective action Wednesday, two weeks after a hearing on the motion.
